CONDITIONS OF SALES

The General conditions of sale herewith reported shall govern the contract to the buyer,  through  electronic commerce (e-commerce) within the web site:  lastravagante.it  managed by LaStravagante ®  di Luisa Corbetta -Carate Brianza (MB) - Italy-  VAT: 09952100965- Rea: MB-1913413.
Such conditions must be known and accepted  by the buyer prior to placing an order. The buyer will benefit of  protections provided in case of good conclusion of distance contracts according to “Consumer code” Titol III, Section II, Legislative Decree 6-09.2005, n. 206, in addition to all other protections in favour of the buyers ruled by the consumer code itself, which can be found at the web site:  codicedelconsumo.it

PURCHASE OF GOODS
For purchasing goods through our web site, you must submit your order and pay according to the following outlined procedures
Herebelow due  steps are specified:

-The buyer can freely view the characteristics of the product, including price and images (which are  to be considered for demonstration purposes only)
-The buyer can select one or more items to buy by placing them in the shopping cart. The contents of your cart will be summarized before the actual order and payment, with all necessary information, including price.

-To proceed with the purchase, the buyer will be redirected to the Paypal circuit in order to to pay in full safety (for more  information go to Paypal's Privacy Policy).

RIGHTS AND OBLIGATIONS
LaStravagante ® will deliver your order to the address provided by the purchaser with a vector specifically commissioned.  Specific information on the time, cost and shipping locations are available in the section “DELIVERY” Paypal.

LaStravagante ® assumes no responsibility or liability for any errors in delivery due to inaccuracies or incompleteness in filling out the order form by the buyer or for any damage to the products after delivery  or for any delays in delivery due to courrier for severe weather conditions, or other circumstances beyond the control of LaStravagante ®.
If some products are no longer available, LaStravagante ® will give notice to the purchaser by email. In that case, LaStravagante ® will reimburse the due amount by crediting your payment card/Paypal account.
In case of buyer consent, LaStravagante ® will send a product other than the one ordered of equivalent value. 

Upon delivery of goods through responsible courrier, the purchaser shall check:
-Packaging, which must be intact, undamaged even in sealing materials
-Amount and type, which must be exactly as indicated on the transport document and on order. If the buyer finds any faults or inaccuracies he/she must immediately inform courrier upon delivery.
The buyer is solely responsible for the truthfulness and correctness of information provided to LaStravagante ® and undertakes to notify of any change in such data.

PRODUCT COMPLIANCE
LaStravagante ® is committed to providing the description and/or pictures of the products shown on its site as closely as possible. The web media contents are intended only for demonstration purposes, the image quality can depend on media tools (PCs, tablets, smartphones, tv) used by purchaser and therefore cause inaccuracies.
In case delivered product is  faulty or different from the one ordered, the buyer shall have the right to request  in alternative:
-The delivery of a product identical to the one ordered, subject to stock availability
-The delivery of a equivalent  product in quality and price, subject to stock availability
-Reimbursement of  product price and shipping charges. 

The warranty shall apply only if goods have been handled with due care and with respect of  products intended use, upon presentation of delivery receipt and indication of the order number by the buyer.

RIGHT OF WITHDRAWAL
In compliance with the provisions of the Consumer Code, the buyer is entitled to rescind the contract without penalty and without giving any reasons within 14 days from reception of goods.
In case of application of right of withdrawal, the purchaser must send appropriate communication to LaStravagante within14 days after receiving the order.
In the case of application of the right of withdrawal, the purchaser is obliged to return the goods to LaStravagante ® no later than  two weeks from communication's date.
The total product integrity will be essential for exercising the right of withdrawal.
The products must be returned:
-Properly packed in their original packaging, with all accessories and documentation
-Equipped with transport document in order to allow  proper identification by LaStravagante ®
-with no signs of use. Return shipping costs will be charged to the buyer.
In the case of  purchaser's failure to comply with the conditions  outlined  in art. 5.5 and 5.6 of  consumer code, the seller reserves the right to deduct from the reimbursement to the buyer an amount corresponding to the decrease of the value of goods returned, giving specific notice to the purchaser.

PERSONAL DATA PROTECTION
LaStravagante ® is committed to respect all confidential personal information provided by the buyer when registering in web site and treat them in compliance with the Legislative Decree 196/03. 

We inform users that the all data supplied may be processed.
The owner of their use is LaStravagante ®. The list of external managers who have access and are entitled to treat data can be requested  directly to LaStravagante ®.

PROCESSED DATA
IP addresses and/or domain names of computers used by users who connect to the site, URI addresses, the method used to submit the request and its timetable. 

In accordance with art. 13 of personal data protection Code Legislative Decree 30.06.2003, n. 196 ss mod, we inform you that your personal data, personal and fiscal data, acquired during registration and/or compilation and sending of  order to LaStravagante ® will be treated: 

-Contractual Purposes, for establishing and executing contractual obligations. Please be aware that these required data are compulsary, therefore any refusal to provide them during registration or compilation and sending of the order, in whole or in part, that is,  the failure to grant their treatment and/or their communication to third parties, will not enable LaStravagante ® to provide required performances.

 
-Promotional marketing purposes, for sending commercial communications, newsletters, advertising material, direct sales. Communications made in compliance with the law and data may be communicated in Italy to providers of electronic communications services and/or company entitled of maintenance of the site www.lastravagante.it.
We inform you that data will not be communicated abroad and/or given to third parties, in Italy or abroad.
As to reported data, you can exercise your rights under article 7 of the Legislative Decree 30.06.2003, n. 196 within the limits and conditions specified in articles 8, 9, 10 of  above mentioned Legislative Decree.
-For legitimate reasons, for the processing of personal data, according to pertinent collection purposes 

-For the processing of personal data,  for sending advertising material or direct marketing or for the performance of market research or commercial communication . The customer may freely exercise these rights at any time,  sending a written request to LaStravagante ® or mailing to the e-mail address lastravagantemilano@gmail.com ;  we will promptly reply you. The data will be processed for the duration of the contractual relationship and also afterwards for promotional/marketing purposes.
The undersigned declares to have received full information  in accordance with art. 13 of the Legislative Decree 30.06.2003, n. 196 and expresses its consent to the processing of data by above menytioned Decree within the limits and for the purposes specified in promotional marketing.

SHIPPING TIMES
The estimated delivery time are 10 working days from the date of execution of the order.
